Welcome to the Mindset by DIVE Studios application (together with all of its features and content and related or commonly owned or operated websites and applications, the “Platform”), made available by Creators Collective, Inc., a Delaware corporation doing business as DIVE Studios (“DIVE Studios”).

How This Privacy Policy Applies

Your privacy is very important to DIVE Studios, and in order to best protect your information, DIVE Studios has adopted this privacy policy (“Privacy Policy”), which applies to any and all information you submit to DIVE Studios in connection with your access to and/or use of the Platform. In order for you to access and use the Platform, DIVE Studios needs to collect and process certain information, which depending on how you use the Platform, may include:

• Personal Information. Information you provide by registering for an Account, such as your name, email address, phone number, profile name, profile picture, Internet Protocol (IP) address, unique device identifiers, etc.

• Location Data. Information about your location when accessing and/or using the Application, if you chose to opt-in.

• Commercial Information. Details of any requests or transactions you make through the Platform, such as the purchase of Premium Episodes.

• Usage Information. Information that is not personally identifiable, but that relates to your usage of the Platform or that is necessary for the proper functioning or improvement of the Platform.

• Communications. Communications you send to DIVE Studios, such as when you request support or a refund, submit comments or questions to DIVE Studios, or report a problem.

DIVE Studios also collects and maintains aggregated, anonymized, or pseudonymized information to protect the safety and security of the Platform, improve the Platform, or comply with its legal obligations.

Types of Cookies DIVE Studios Utilizes

DIVE Studios uses the following types of cookies and other technologies:

• Security: Facilitates security features and allows DIVE Studios to detect activity that might violate the Terms and Conditions of Use.

• To address inquiries and respond to customer service requests;
• To track and analyze use of the Platform and DIVE Studios’ services;
• To maintain security and to enforce the Terms and Conditions of Use;

California Users

California-resident Users have additional privacy rights, including:

• The right to request that DIVE Studios disclose certain information about our collection and use of your personal information over the past 12 months.
• The right to request that DIVE Studios delete any of your personal information.

European Union Users

DIVE Studios’ lawful bases for processing personal information include:

• Consent: You have provided DIVE Studios with consent to collect your personal data for specific purposes.
• Contract: DIVE Studios may need your personal data to comply with contractual obligations.

How DIVE Studios Shares the Information It Collects

DIVE Studios shares information collected from Users in the following ways:

• Users' engagements with Interactive Functionalities are attributed through their Account username.
• Information may be shared with trusted third-party service providers for services, including payment processing.
• DIVE Studios reserves the right to disclose information as necessary to comply with the law or protect DIVE Studios’ rights.

Information DIVE Studios Never Shares Publicly includes:

• Your name;
• Your email address;
• Any payment information you provide.

The Platform may include links to websites or services whose privacy practices may differ from DIVE Studios’ practices.

DIVE Studios may change the Privacy Policy at any time and new versions will never apply retroactively.
